GENERAL CONDITIONS: ArtViva The Original & Best Walking Tours, hereby referred to as “ArtViva”, is a licensed Tour Operator based in Florence Italy, lic. no. 516411. ArtViva is not liable for any loss or damage of possessions, personal injury or death. The company is not responsible for any injury, loss, delay, inconvenience caused by force majeure or other events such as strikes, wars, acts of terrorism, floods, severe weather, acts of god, traffic delays, or any other circumstances which are beyond our control. We reserve the right to modify and integrate these terms and conditions at our discretion.
TOURS & SERVICES: All group tours are conducted in English only unless otherwise noted. By reserving any tour or service, it is agreed that all participants have read the tour description and have agreed to all the terms and conditions, as well as any extra requirements that may appear with the individual tour or product descriptions, such as minimum numbers required to run tours, dress codes, weather limitations, child suitability, etcetera.
OUR RESPONSIBILITY: ArtViva agrees to provide services on the understanding that you and the persons you reserve for are fit and healthy enough to complete the tour and accept that in any tour or service some risk may be involved. When you book a tour or other service with us, you acknowledge and accept that Artviva, its agents and suppliers, in making arrangements for hotels, tours, transportation or any service in connection with the itineraries of individual tour members shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any hotel, carrier or other company or person providing services included in the tours and transfers or museum or other bookings. ArtViva, its agents and suppliers accept no responsibility for any entry delays, strikes, sickness, pilferage, labour disputes, machinery breakdown, government restraints, acts of war and terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control. We reserve the right to cancel, change or substitute any service and to decline to accept any tour members at any time for any reason including, without limitation, insufficient number of participants. All documents/vouchers are issued subject to the terms and conditions specified by ArtViva, its agents and suppliers.
CONFIRMATIONS: Full payment must be received to confirm tours. We may request a bank transfer for payments over 1000 euro. We do not take responsibility for non-receipt of emails. Please ensure your spam filter is not blocking emails from staff@artviva.com or privatetours@artviva.com. An automatic confirmation is sent upon booking online. If you do not receive an email confirmation, please check your spam folder or email us at staff@artviva.com or phone our company main office. CHANGE & AVAILABILITY: All tours, services and prices are subject to change and availability. ArtViva reserves the right to modify and integrate all inclusions and services without prior notice. This may be due to but not limited to closure of included locations, traffic, weather, strikes and protests, restoration or construction works and others.
REBOOKING: If you request to rebook a tour/service, ArtViva will try to satisfy your request but cannot guarantee availability of date/time change requested. Requests for changes received less than one week for public tours and two weeks for private tours will incur a rebooking fee of €15/person plus any non-refundable costs incurred (such as museum tickets and reservation fees).
CANCELLATIONS & REFUNDS: We cannot refund a client for services that are not utilised. No refunds will be provided to clients who cannot complete the tour for health or fitness reasons, nor to those who lose the tour group/guide. You must be at the meeting point 15 minutes before tour or service departure. No-show or non-arrival in time for tour departure will result in a 100% forfeiture of all moneys paid. Cancellations must be requested via email at least 3 weeks prior to the tour in order to receive a full refund for public tours. Any cancellations requested more than 72 hours prior but less than 3 weeks for public tours, more than two weeks for private tours and 60 days for custom tours and services will result in a 20% cancellation fee plus any non-refundable costs incurred (such as museum tickets and other services charges). For cancellations received less than 72 hours for public tours, 2 weeks for private tours and 60 days for custom tours/services prior to the start of a tour/service, no-shows or late arrivals, 100% of the tour price/service fee will be forfeited.
CANCELLATION BY ARTVIVA: We reserve the right to cancel or change any tours without penalty in case of circumstances beyond our control or for any other reason including when the minimum number of participants as specified in the tour program is not reached, or if the tour is not available on the dates requested. In these rare instances, alternative dates/tours or activities may be suggested but if the client does not wish to avail of the alternatives presented, s/he will be fully reimbursed only for the cost of the services paid to ArtViva. ArtViva is not responsible for additional expenses that may be incurred by a client in relation to a cancelled tour, such as transport or accommodation costs. In the event of cancellation by Artviva (except for caused by force majeure or other events such as strikes, wars, acts of terrorism, floods, severe weather, acts of god, traffic delays, or any other circumstances which are beyond our control) a full refund will be provided.
CANCELLATION BY ARTVIVA DUE TO FORCE MAJEURE: In the event a tour is cancelled by Artviva due to force majeure or other events such as strikes, wars, acts of terrorism, floods, severe weather, acts of god, traffic delays, or any other circumstances which are beyond our control; Artviva will do our best to make a refund but cannot guarantee a full refund for all costs of the tour that are not refundable to Artviva. Please ensure you have travel insurance that covers you for interrupted or cancelled services due to strikes, wars, acts of terrorism, floods, severe weather, acts of god, traffic delays, or any other circumstances which are beyond our control.
ARRIVAL TIMES: We recommend arriving 15 minutes before departure time for all tours and services. We are unable to delay departure due to late arrivals and we reserve the right to cancel your reservation if you do not arrive at the allocated meeting point for the stated departure time. For late arrivals, it remains at our discretion if rebooking is available, with the stated rebooking charges incurred. Refunds cannot be provided for non-arrivals. Artviva is not responsible for late arrivals caused by transport delays or strikes. We strongly suggest the use of public transport wherever possible. However, if you must drive, please allow plenty of time to get to the tour meeting points as it is difficult to drive in Italy. You should also allow ample time for parking. Most city and town centres in Italy are closed to traffic or require a permit to enter. If you enter a “ZTL” area (limited traffic zone), video cameras capture your license plate and a fine may be sent to your home.
PERSONAL BELONGINGS: Large bags and backpacks are not permitted in museums and there are no convenient storage facilities. There is no secure location to leave items in the ArtViva office and we cannot take any responsibility for left items. Storage facilities are available at most train stations or your hotel.
DRESS CODE: Knees and shoulders must be covered for entry into churches. We recommend comfortable walking shoes, with closed-toe footwear required for bike tours and any others involving walking on mixed terrain. Refunds cannot be granted if you cannot join or complete a tour for lack of correct attire.
SOUND SYSTEMS: If a sound system is provided for a tour, it must be returned in good condition or a fee of up to 150 euro per headset will be charged for the loss or damage.
NON-SOLICITATION
Non-Solicitation of Clients/Partners/Suppliers/Vendors/Employees/Ex-Employees.
Client and or Partner acknowledges and agrees that he shall not, directly or indirectly, solicit, take away or divert, or attempt to solicit, take away or divert, the business or patronage of any Client/Partner/Employee/Employee or Customer of the TOBWT with the intention or for the purpose of providing services that compete with, undercut or avoid the services provided by the ArtViva.
If Partner/Client needs to contact a Supplier, Vendor-Partner/Client shall request through ArtViva via email, unless agreed to otherwise by Artviva.
ACCOMMODATION DAMAGE
We will charge your credit card for any damage or extra costs incurred or made during your stay in any accommodations we provide or booked through us.

PRIVACY: For the establishment and execution of the contract with you, our organization comes into possession of some of your data, also acquired verbally, qualified as personal by the European Regulation 2016/679 (GDPR).
According to the law, this treatment will be based on principles of correctness, lawfulness,transparency and protection of your privacy.
According to article 13 of the GDPR 2016/679, therefore, we provide you with the following information:
Nature of the data processed: We process your data:
- Anagraphic, fiscal and of an economic nature necessary for the performance of contractual relationships with you, whether current or future;
- Spontaneously supplied by you for the personalized execution of the current or future contract, bearing in mind that there is no obligation on your part to supply them.
The data are processed with your express consent (Article 24 letter a, b, c Privacy Code and Article 6 letter b, and GDPR) accepting – with a click in the box at the end of the completion of the form – the terms and conditions of the service we perform. All data will be used solely and exclusively to fulfill:
- Pre-contractual, contractual, post contractual and tax obligations arising from relationships with you;
- To the obligations established by law, regulations, community legislation or an order of the Authority.
We are not in possession of your data that can be classified as sensitive, particular or of a judicial nature (articles 9 and 10 of the GDPR).
Purpose of the processing and duration: Your data are processed for the entire duration of the relationship contract and also subsequently, for contractual requirements and related fulfillment of legal obligations and taxation, and for effective management of financial and commercial relationships.
The Data Controller will process personal data for the time necessary to fulfill the aforementioned purposes and in any case for no more than 10 years from the termination of the relationship for the purposes of service.
Methods of processing: The processing will be carried out with both manual and / or computerized tools telematics with organizational and elaboration logistics closely related to the purposes themselves and however in order to guarantee the security, integrity and confidentiality of the data in compliance with the organizational, physical and logical measures provided for by the provisions in force.
Obligation or right to provide data: As regards the data that we are obliged to know, in order
to fulfill the obligations established by law, their non-conferment by you involves the impossibility of establishing or continuing the relationship, to the extent that such data are necessary for execution of the same.
Scope of knowledge of your data: The following categories of subjects may become aware of
your data, as managers or processors, appointed by the undersigned company:
- Data controller;
- Accounting and billing staff;
- Those involved in the marketing and execution of services.
Communication and dissemination: Your data will not be disseminated to third parties by us
for their provision or consultation.
Your data may be communicated by us to entities, as far as their respective and specific competence is concerned and in general to any public or private entity with respect to which there is obligation for us (or faculty) recognized by law or secondary or community legislation) or need for communication, as well as to our consultants, within the limits necessary to carry out their duties at our office organization, after our letter of appointment imposing the duty of confidentiality and security.
Rights of the interested party: In accordance with Art. 7 of Legislative Decree 196/03 of the Articles of the GDPR 679/16: 15 / Right of access, 16 / Right of rectification, 17 / Right to cancellation, 18 / Right to limitation of treatment, 20 / Right to portability, 21 / Opposition right, 22 / Right to oppose the automated decision-making process of GDPR679 / 16. Withdrawal of consent: With reference to Art. 23 of Legislative Decree 196/03 and Article 6 of GDPR 679/16, you can revoke the consent given at any time.

Vouchers To Be Used Within 1 Year in Lieu of Refunds
D.L. 2 marzo 2020, n. 9 (1).
Misure urgenti di sostegno per famiglie, lavoratori e imprese connesse all’emergenza epidemiologica da COVID-19.
Art. 28. Rimborso titoli di viaggio e pacchetti turistici
1. Ai sensi e per gli effetti dell’articolo 1463 del codice civile, ricorre la sopravvenuta impossibilità della prestazione dovuta in relazione ai contratti di trasporto aereo, ferroviario, marittimo, nelle acque interne o terrestre stipulati:
a) dai soggetti nei confronti dei quali è stata disposta la quarantena con sorveglianza attiva ovvero la permanenza domiciliare fiduciaria con sorveglianza attiva da parte dell’autorità sanitaria competente, in attuazione dei provvedimenti adottati ai sensi dell’articolo 3 del decreto-legge 23 febbraio 2020, n. 6, con riguardo ai contratti di trasporto da eseguirsi nel medesimo periodo di quarantena o permanenza domiciliare;
b) dai soggetti residenti, domiciliati o destinatari di un provvedimento di divieto di allontanamento nelle aree interessate dal contagio, come individuate dai decreti adottati dal Presidente del Consiglio dei ministri ai sensi dell’articolo 3 del decreto-legge 23 febbraio 2020, n. 6, con riguardo ai contratti di trasporto da eseguirsi nel periodo di efficacia dei predetti decreti;
c) dai soggetti risultati positivi al virus COVID-19 per i quali è disposta la quarantena con sorveglianza attiva ovvero la permanenza domiciliare fiduciaria con sorveglianza attiva da parte dell’autorità sanitaria competente ovvero il ricovero presso le strutture sanitarie, con riguardo ai contratti di trasporto da eseguirsi nel medesimo periodo di permanenza, quarantena o ricovero;
d) dai soggetti che hanno programmato soggiorni o viaggi con partenza o arrivo nelle aree interessate dal contagio come individuate dai decreti adottati dal Presidente del Consiglio dei ministri ai sensi dell’articolo 3 del decreto-legge 23 febbraio 2020, n. 6, con riguardo ai contratti di trasporto da eseguirsi nel periodo di efficacia dei predetti decreti;
e) dai soggetti che hanno programmato la partecipazione a concorsi pubblici o procedure di selezione pubblica, a manifestazioni o iniziative di qualsiasi natura, a eventi e a ogni forma di riunione in luogo pubblico o privato, anche di carattere culturale, ludico, sportivo e religioso, anche se svolti in luoghi chiusi aperti al pubblico, annullati, sospesi o rinviati dalle autorità competenti in attuazione dei provvedimenti adottati ai sensi dell’articolo 3 del decreto-legge 23 febbraio 2020, n. 6, con riguardo ai contratti di trasporto da eseguirsi nel periodo di efficacia dei predetti provvedimenti;
f) dai soggetti intestatari di titolo di viaggio, acquistati in Italia, avente come destinazione Stati esteri, dove sia impedito o vietato lo sbarco, l’approdo o l’arrivo in ragione della situazione emergenziale epidemiologica da COVID-19.
2. I soggetti di cui al comma 1 comunicano al vettore il ricorrere di una delle situazioni di cui al medesimo comma 1 allegando il titolo di viaggio e, nell’ipotesi di cui alla lettera e), la documentazione attestante la programmata partecipazione ad una delle manifestazioni, iniziative o eventi indicati nella medesima lettera e). Tale comunicazione è effettuata entro trenta giorni decorrenti:
a) dalla cessazione delle situazioni di cui al comma 1, lettere da a) a d);
b) dall’annullamento, sospensione o rinvio del corso o della procedura selettiva, della manifestazione, dell’iniziativa o dell’evento, nell’ipotesi di cui al comma 1, lettera e);
c) dalla data prevista per la partenza, nell’ipotesi di cui al comma 1, lettera f).
3. Il vettore, entro quindici giorni dalla comunicazione di cui al comma 2, procede al rimborso del corrispettivo versato per il titolo di viaggio ovvero all’emissione di un voucher di pari importo da utilizzare entro un anno dall’emissione.
4. Le disposizioni di cui ai commi 2 e 3 trovano applicazione anche nei casi in cui il titolo di viaggio sia stato acquistato per il tramite di un’agenzia di viaggio.
5. I soggetti di cui al comma 1 possono esercitare, ai sensi dell’articolo 41 del decreto legislativo 23 maggio 2011, n. 79, il diritto di recesso dai contratti di pacchetto turistico da eseguirsi nei periodi di ricovero, di quarantena con sorveglianza attiva, di permanenza domiciliare fiduciaria con sorveglianza attiva ovvero di durata dell’emergenza epidemiologica da COVID-19 nelle aree interessate dal
contagio come individuate dai decreti adottati dal Presidente del Consiglio dei ministri ai sensi dell’articolo 3 del decreto-legge 23 febbraio 2020, n. 6. In caso di recesso, l’organizzatore può offrire al viaggiatore un pacchetto sostitutivo di qualità equivalente o superiore, può procedere al rimborso nei termini previsti dai commi 4 e 6 dell’articolo 41 del citato decreto legislativo 23 maggio 2011, n. 79, oppure può emettere un voucher, da utilizzare entro un anno dalla sua emissione, di importo pari al rimborso spettante.
6. In relazione alle ipotesi disciplinate dall’articolo 1, comma 2, lettera f), del decreto-legge 23 febbraio 2020, n. 6, il rimborso può essere effettuato anche mediante l’emissione di un voucher di pari importo da utilizzare entro un anno dall’emissione.
7. Nei casi di cui ai commi 5 e 6, il vettore procede al rimborso del corrispettivo versato per il titolo di viaggio in favore dell’organizzatore ovvero all’emissione di un voucher di pari importo da utilizzare entro un anno dall’emissione.
8. Le disposizioni di cui al presente articolo costituiscono, ai sensi dell’articolo 17 della legge del 31 maggio 1995, n. 218 e dell’articolo 9 del regolamento (CE) n. 593/2008 del Parlamento europeo e del Consiglio, del 17 giugno 2008, norme di applicazione necessaria.
9. Alla sospensione dei viaggi ed iniziative d’istruzione disposta dal 23 febbraio al 15 marzo ai sensi degli articoli 1 e 2 del decreto-legge 23 febbraio 2020, n. 6, e dei conseguenti provvedimenti attuativi, si applica quanto previsto dall’articolo 41, comma 4, del decreto legislativo 23 maggio 2011, n. 79, in ordine al diritto di recesso del viaggiatore prima dell’inizio del pacchetto di viaggio nonché l’articolo 1463 del codice civile. Il rimborso può essere effettuato anche mediante l’emissione di un voucher di pari importo da utilizzare entro un anno dall’emissione.
